Closing your account
You can cancel your account at any time and you will no longer be billed for the service on the next billing date due.
As you are responsible for keeping your password confidential, we are not responsible for any losses due to stolen or hacked passwords. We can’t see your password, and we can only reset it. If you suspect any unauthorized use of your account, please inform us immediately.
Our fee structure is stated on our website. Payments are due each month in advance on the same (or closest) day as the day you signed up. If you go over your subscriber limit, you will have to pay at the higher level on or before the next payment due date.
Payments are made via a credit card that you are authorised to use. You’ll authorise us to deduct the monthly fee against your credit card and update your credit card details when your card expires. If a payment is rejected, we’ll suspend your account until payment can be resolved.
Using the service
Publishing Spark is designed for authors to communicate with their readers (and not for businesses offering other goods and services). You agree that you won’t send spam; use purchased, rented or third-party email addresses; send content which incites hatred, is pornographic or explicit, or which promotes illegal goods and services; use misleading subject lines; share your password; decipher, decompile, disassemble or reverse engineer any of the software used on Publishing Spark; import or incorporate social security numbers, passwords or sensitive personal information of any kind into lists or emails.
We take the CAN-SPAM laws seriously.
This means that you must provide a physical address on each email sent (a PO Box is also acceptable); and that there is an unsubscribe link in every email.
You may only use Publishing Spark author email service to send emails to people who have given you permission to send emails to them, who have not complained or marked your message as Spam, or unsubscribed. You may import a number of email addresses per month from a CSV file (for example if you are migrating your list from an existing mailing list provider).
Violating any of these requirements means not only that ISPs will block emails from you, but that we will be forced to close your account with us.
You agree that your use of the service complies with all laws and regulations, including the EEA (European Economic Area) regulations on data protection, electronic communication and privacy laws. In addition, you agree to indemnify and hold us harmless from any losses or legal fees that result from your breach of any part of these regulations.
You assume full responsibility for any loss; indirect, punitive, special or consequential damages that result from your use of Publishing Spark. Our total liability is limited to the monthly fee that you pay for the service. Furthermore, you indemnify and hold us harmless from any losses or legal fees that result from any claims you make or which result from third-party claims. We are not liable for any failure in our service due to circumstances beyond our control, such as acts of God, power blackouts, acts of hackers, third-party internet service providers or any other issue beyond our control.
If, by breaking the terms of our service, you cause us to incur damages, we will seek damages from you. In the case of legal dispute, both parties will be bound by UK laws.
